Jury for Man Who Raped 10-Year-Old Selected

LANE COUNTY, Ore. --  A rare court case is underway for the man who admitted to kidnapping and raping a 10-year-old Eugene girl last January.

 

Malcom M. Gerlach was in a Lane County courtroom Tuesday sitting directly across from the potential jurors who will decide whether he's guilty by insanity.

 

Prosecutor Erik Hasselman, who represents the state, said this is a somewhat unusual case because Gerlach has already confessed to his charges, so the burden of proof rest on Gerlach's attorney.

 

The 25-year-old from Santa Rosa, Calif. sat quietly next his to attorney Rebecca Davis while she questioned potential jurors.

 

In January, Gerlach kidnapped a young girl while she was riding her bike, raped her and then led police on a car chase that ended in a wreck. Since then, he's confessed to nearly a dozen counts of felony. In addition to rape and kidnap, he's also admitted to assault and reckless driving.

 

Both attorneys spent the whole day selecting what they hope is an impartial 12-person jury. They say they expect this case to last through next Wednesday.
