EUGENE, Ore. -- Ben Bond, the man at the center of a downtown Eugene parking meter controversy, will face a judge Thursday.
But he may not enter a plea to his obstruction of government or judicial adminstration charge.
Bond's lawyer wants prosecutors to explain how specifically his client broke the law during an altercation with a Eugene parking officer last month to see if this case can be decided by a jury, not a single judge.
Attorney Bill Wiswall says in all the documentation he's received, the prosecution has only listed the law they believe Bond has broken and has not specifically noted what action Bond took to break that law. Wiswall says that makes it nearly impossible to build a case.
"I don't know which of those they are talking about and so there might not be any economical interference for example because Ben was giving an economic benefit to the city when he was plugging meters. He was giving them money that they might otherwise not have been entitled to or received," said Bond's attorney Bill Wiswall.
Wiswall will also make a motion to have this case decided by a jury instead of a single municipal court judge. The judge and the parking enforcement officer are both municipal employees and Wiswall says that could be perceived as conflict of interest.
If sustained Thursday, those two motions could delay the entrance of a plea. But when that time does come, Bond is expected to enter a not guilty plea.

People who just sit around and let these "parking CONTROL (not enforcement) companies" do this crap is just plain laziness. They're not in it for the money in the meters, they're in it for the tickets and OF COURSE the mayor and city/county officials will back the money makers. Im sorry, but making 20 dollars or so off of someone who didn't put a dime in the machine is just a scam, that way too much commission, and yet these funds are supposed to help our cities but all the cities complain about is how much debt they're in. I award this guy for saving some people money from scammers who dont even listen to you when you try to appeal the ticket, they take your money and run. Unless this man is clearly in her personal space, clearly yelling at her, or approaching/blocking her, then he is just exercising his freedom to do what he want so long as it causes no harm.
