Parking Meter Controversy Continues

EUGENE, Ore. --  We're learning more about a Eugene man, Ben Bond, who was fined $810 after a confrontation with a meter maid.  The trouble started Wednesday when Bond tried paying the expired parking meters of strangers.

 

Outside the Fifth Street Market is where Ben Bond was arrested.  He admits he fed the expired meters of strangers and used profanity at one point when he stopped his truck and confronted a Eugene parking enforcement officer.  He says he never physically got in her way and was just trying to make sure other people avoided getting hit with parking tickets.

 

"They asked me what I was doing and I said 'Trying to keep the meter maid from getting a cramp in her hand from writing tickets'. And they instantly said 'Put your change in your pocket. You are under arrest,' " said Bond.

 

Ben Bond never believed putting a few coins in a few parking meters could lead to this. "The handcuff marks are still on my hands," said Bond.

 

The 30-year old was arrested by Eugene Police Wednesday and charged with Harassment and Obstruction of Governmental Administration after a run in with one of the city's parking enforcement officers. What sparked the incident was what Bond considered an act of kindness: putting coins in the expired parking meters of strangers.

 

"Got into my truck, and she pulled right here right as I was getting ready to put the money in and she said she saw that it was expired and that she's still getting a ticket," said Bond.

 

The parking services employee advised him to stop, then she moved on down Fifth Street.

 

"Had a pocket full of change and decided nobody else needs to get a ticket on this street and decided to change everybody up," said Bond.

 

Bond admits to stopping his truck next to the parking attendant outside the Fifth Street Market and confronting her. "I told her 'I don't think you're a crappy person, but what you're doing is a crappy ordeal," said Bond.

 

Bond parked, paid his own meter, then continued to pay others. "When I pulled up across the block, she instantly just stopped doing her job and I figured she was calling the police and I stuck around and waited for them," said Bond.

 

Three officers arrived, and within moments Bond was in cuffs and in a police cruiser.  "I didn't have a chance from the get go. As soon as they showed up, I think minds were made up that I was going to be arrested and fined," said Bond.

 

Meanwhile, KEZI 9 News spoke with another witness to this incident.  He didn't want to go on camera, but what he says corroborates much of Bond's recollection of events that the only time Bond confronted the parking officer was from inside his truck and he did not block her from doing her job. He says Bond disappeared for a short time as police were called to the scene.  Bond says he intends to fight his charges in court.

 

When our photographer arrived at the scene Wednesday night, the responding police officers left before we could contact them.  We made four separate calls to the Eugene Police Department. None were returned before our story first aired.

 

The Eugene Police Department spoke with KEZI 9 News Thursday morning.  They were eager to talk with us and tell their side of the story.  We sat down with EPD's Patrol Captain Rich Stronach.

 

It should be noted though, Captain Stronach was not on the scene, had not seen a copy of the report, and said he only had a brief talk with one of the responding police officers.

 

"This guy was running ahead and putting coins in the meters as the parking control officer would stop to begin writing citations," said Eugene Police Capt. Rich Stronach.

 

Captain Rich Stronach says that's not what led to 30-year-old Ben Bond's arrest, but he claims Bond's verbal assaults and following a parking enforcement officer is what landed him in the back of a patrol car.

 

"She did finally start to feel physically intimidated. I can't tell you what was said, I haven't seen the report like I said, I don't know what exactly he said," said Capt. Stronach. "Eventually got to the point where she felt threatened enough where she contacted police."

 

KEZI 9 News asked further about that physical intimidation.

 

"What the officer described to me was over the course of several blocks, of this parking control officer trying to do her job, that he continually followed along was interfering with her. I'm going to assume her way was blocked, exactly what went on I can't tell you. Like I said I wasn't there, I haven't even read the report. I spoke with the officer briefly this morning about it," said Capt. Stronach.

 

But after our cameras were off, Stronach called the officer and told KEZI 9 News that Bond did not physically block the parking enforcement officer from doing her job. Stronach says when officers arrived on the scene Bond wasn't around. It was later while three EPD officers were talking to the parking control officer that Bond walked by.  According to Capt. Stronach, after talking with him, police put him in handcuffs and into the patrol car. "The officers elected to put him in handcuffs, and it was very non eventful. Contrary to one account where he was thrown up against the wall, that did not occur," said Stronach.

 

However, five witnesses who spoke with KEZI 9 News say otherwise. They say he was handled harshly.  "The only thing I can suggest to the people that reported to your cameraman that they're perception is that they were seeing what was going on at this one particular point. Again, parking control officers deal with this stuff all the time just not to this extent," said Capt. Stronach.

 

Police cited Bond for Harassment and Obstructing Governmental Administration. With Bond's citations, he had two options: spend the night in jail or receive a citation for $810, stop his behavior, and leave the area. He opted for the fine and left.

 

The harassment charge comes with a $280 fine. Obstructing Governmental Administration packs a $530 fine. The harassment charge is for those verbal assaults, but what is the obstruction of governmental administration for if it wasn't for plugging parking meters?

 

The definition according to Oregon law states, "If the person intentionally obstructs, impairs or hinders the administration of law or other governmental or judicial function by means of intimidation, force, physical or economic interference or obstacle."

 

So how was Bond hindering the parking enforcement officer from doing her job? Police say he did not block her, those verbal assaults were for the harassment charge. He was filling those meters though, but police say he wasn't charged for that.  Bond is set to appear in court on January 28th, and he plans to fight it.

 

KEZI 9 News also spoke to Mayor Kitty Piercy about the incident. She maintains this is not a case about plugging a meter but rather someone harassing a city employee.

 

While EPD maintains that Bond was not actually fined for plugging meters, there is an ordinance on the books that says it's illegal to feed other people's meters.

 

The city though says that law's not enforced.  In turn, Mayor Piercy says she stands by the actions of everyone involved on the city's side of things.

 

"The message from me to the people of this community is if they think we would ever send an officer out over a meter plugging incident, we wouldn't. And secondly, we do support and admire people who try to be Good Samaritans and help their fellow citizens," said Piercy.

 

Mayor Piercy says, while Ben Bond may have been trying to be a Good Samaritan, that's not what this case is about.

 

"It's really about what happened after that where an employee doing her job was harassed and intimidated and felt so frightened for her well being she had to call the police to help her out. That's the issue that's at hand," says Piercy.

 

City Councilor Mike Clark agrees.  "At the end of the day, I think it's a good idea to try and do the Good Samaritan type of thing that he was doing, but it's a bad idea to harass and follow people down the street when you're mad about it," said Clark. "You don't get to yell and you don't get to threaten city employees, even if they behave dumb or mean."

 

What both Clark and the mayor are assuming of course is that Bond's story isn't true. As it stands, the city has yet to offer up an interview with any of the officers who were on the scene or the woman who Bond had the confrontation with. That's all stacked against the eyewitness accounts who say Bond was not physically threatening or impeding the officer.

 

Meanwhile, Clark says situations like this could be avoided if the city would just get rid of meters in the first place. "People are sick to death of getting tickets at parking meters, and that's why I've been trying to get rid of them for a year. I think that's what really creates the rub her," said Clark.

 

When KEZI 9 News spoke to parking services Wednesday morning, they initially agreed to speak to us, though they stipulated they would only talk about parking operations and not about the incident itself. They told KEZI 9 News they first needed to check in with the police department.  From that point on though, they did not get back to us and did not return any of our calls.

In the mid 90's, the Eugene City Fathers ended the free parking program, installed meters and hired a group of overzelous people to go around giving tickets and booting cars.
I watched as downtown went down and down the tubes. At one point, the police were hassleing the only people who wanted to be downtown (the mall rats).
Who wants to go downtown for any reason with such agresive ticketing, not to mention the agresivness of the EPD.
To solve this problem, we need to make downtown a friendly place again, kind of like Valley River Center or Gateway, without the police or meter people roming the streets looking to give tickets and hassle people for petty stuff.
Free parking downtown would be a good start.

Ben Bond should receive a civic medal for trying to prevent the City issuing parking tickets for expired meters. The over-reaction of the police department is frightening. Do they have so little to do that they can invent threats to justify their actions?

The City Council, on one hand, wants downtown to be a friendlier place. On the other hand, they evidently condone such bullying and threatening tactics by the Police Department. Hitler used brown shirts to identify his select corps of Gestapo. Sounds like it's time to outfit the Eugene Police Department in the same color shirts.

the only reason the city made a stink about this dude "plugging" is because 25 cents is cheaper than a parking ticket. those idiots on the city council vote themselves a raise twice a year, the money has to come from somewhere? it sure isnt going back into the community. bottom line this guy was putting some smiles on peoples faces, i wasnt even parked there and it made me smile,in times like this its hard to find people who give a dam about each other, for what ever reasons.this guy gets whacked for it, whats next we cant smile at each other or say hello. im sure that he got upset when confronted, i would to, i would have got arrested too.

all in all i think we should put together a fundraiser for this guy to help him pay for his fine, obviously he would do it for us, and im not going to feel bad for waiving at someone or putting change in their parking meter. i dont even care if i get arrested for it, thats just what good people do for each other.

I agree the police obviously over-reacted in this case and the meter maid needs to chill out too!!!!!! An $810 fine is ridiculous. I know Ben Bond and he is down to earth, kind and hardworking. I hope in the future the police use their time arresting theives and drug addicts that are the real problem in this community,and leave the good samaritan to brighten someones day..... GO BEN!!!! At least there are still some good and genuine people like you out there:)

That is crazy. That man was trying to help others. How can they arrest him for that? I would have done the same thing. That meter maid just wants to create drama. She should be released from her job and go find something else. This story really upsets me and i plan to complain to the city, the police, and the mayor about this.
They are doing no good for this city.

Not surprising that Kitty Piercy is standing behind the EPD and the "harassment" angle. Maybe it is in her job description to back the "taze/arrest/fine first, ask questions later" policy of our lovely local police officers.
But what really bothers me is that she says "The message from me to the people of this community is if they think we would ever send an officer out over a meter plugging incident, we wouldn't. " But you did. And if your citizens think that, then what does that tell you about your police department, and the faith our citizens have in their ability to serve and "protect" us?
One of the viewers that called in said that this could be the straw that broke the camel's back with the EPD, and maybe that should have been with the tazing incident of the University student who didn't speak English? The message is, Mayor Piercy, you have A LOT of work to do with the police department and it's officers. Blame Ben Bond's actions on harassment or whatever you feel makes them look better but it doesn't negate the fact that Eugenians have serious trust issues when it comes to their officers, and incidents like this just make them worse.

Question his motives however you want. But how do you know he isn't a man who was just laid off from his job, thinking of others trying to help them not have to pay a ticket?

And as far as I am concerned, the longer this meter maid refuses to comment, the more her "harassment" claim goes down the drain.

I hope many good things come from this, and may one of them NOT be the city gaining revenue from this kind man's fines.

The only Gestapo behavior was displayed by Ben Bond. What a jerk! Parking control officers don’t make the law. Let them do their work and if you don’t like it, change the law. I hope next time Ben tries to stalk a city employee he picks on someone his own size. Maybe then he’ll get what he really deserves.

Parking Meter Controversy

If the meter is paid, who cares were the money came from. This man is doing a good deed and it should be an inspiration to others. Pass it on. Sometimes we get stuck in an appointment or what not and cannot get back to the meter in time. This is no reason for the City to profit by writing a ticket. Some of these people do not have money to pay the ticket. It is hard enough to feed the meter.
As a governmental representative this meter maid should step down. I have worked in a government position for 24 years, and by no means would I stoop to treating the people that pay my check to this level.
This is a HORRIBLE representation of government workers doing their job. Our jobs are to serve the people, Not to gouge them every chance we get.
Retraining is not enough, as I have seen to be the resolution in most cases of government incompetence.
If this meter person has not enough common sense and respect for those that pay taxes which in turn pay her wages, she needs to find another job.

Bendover I respect your right to voice your opinion, however it appears the EPD and the meter maid are the only ones who agree with you. The many witnesses to the incident confirmed Ben's side of the story and he wasn't stalking anyone... and FYI he is not a jerk.

Parking Meter

Ben Bond is a hardworking individual and this whole mess should be dismissed. He should not be charged with anything for doing an act of kindness. He is a person with a big heart and is always there helping his fellow neighbors. He is a Hero to all those that didn't get a ticket because he paid your meter and there should be more good people like him in this world.

There is simply no other reasonable way to frame it. The employee probably can’t comment until it goes to court so this whole thing is definitely very one sided for now. FYI…elected officials such as Mayor Piercy and Councilman Clark, who probably have much better information about the incident agree with this position too. Anytime a parking control officer, already used to a certain level of abuse, feels the need to call the police, it should signal to most reasonable people that this guy went too far. He should have walked away instead of stalking this poor employee. For him to go to the media and pretend that he was trying to do a good deed is just a big load of you know what. The parking control officer just tried to do her job. He should have tried to do his job too. Oh that’s right….he’s unemployed so I guess that gives him a right to be a jerk.

The Mayor and Clark have better information? They have the information the cops give them. The cops only have what the meter maid said. And yet they automatically are acting like what she said was the truth. He stands no chance in court. Because the Judge, just like the mayor and Clark are going to take the word of the city employee. And then you'll come running and say "See!" You hear either one of them say they talked to anyone involved? No. Of course not. Just like is always the case the cops word is golden for them. Ask our former auditor how it worked out to tell the cops in this town they're wrong. Oh she quit. So lets ask the current guy how his advice is being taken by Pete Kearns. Oh, he ignored him. The parking meter maid is way out of hand. I got three tickets for parking on Harris St. while working on a lady's home there. One of the tickets was for blocking the sidewalk after I was told to move our company van. I moved the van it was a couple of inches into the sidewalk and I was working right in the garage. I couldn't get the van any farther into the drive and I was still right there. She didn't even make an effort to ck w/ me to let me know I was still in violation. I got one for parking my personal car in front of the driveway to the home we were working on. I did not know there was a law against parking in front of your own driveway but that's what I was told. The meter maid knew I was working there and knew it was my car yet she still ticketed me w/ out even a warning or cking w/ me or anything. Geez I realize this whole deal is about money but what is going on in this ladys' head? Aren't the people supposed to serve the public good? What's good about ticketing law abiding citizens w/o warning when we are just trying to do our jobs? This lady needs a little reality ck. I think she must be a police woman wanna be. Some day this person will get a parking ticket herself and then what??? Sorry folks but this is just wrong. And then to call the police and have Bond arrested for what? Alledgedly harrasing her? She is harrasing US. I wonder if she is paid a bonus for the amount of tickets she writes. Very bad press Eugene. Very bad press Mayor Percy. What would your mothers say?

The man was putting quarters in the meter and she issued citations anyways. If she had not issued the parking ticket, they probebly would not of had words. How can the city justify writting a parking ticket as long as there is money in the meter? Is there a law stateing the driver of the vehical must be the one to insert the money into the meter? That is the most childish thing I have ever heard. The news said he was ahead of her putting money in the meters, now they are changing the story to he was following her around verbaly harsing her. I think the city is trying to turn things around to justify thier actions. The city might find other people doing the same thing in the next few days. How will they be handled? If they just put money in and dont have any words with the meter maid, how will they handel that? How can you ticket someone who merly is putting money in meters?

I agree with almost all the people who gave their comments here. Ben should be refunded and those people who arrested him including the meter maid and everyone involved should apologize. People who work in the government should know better about helping people. Help him make this city a better one. Had this guy not used profanity and not followed the parking enforcement officer down the street he would not be in this position. You can't go around intimidating people and not expect consequences. Who's being harassed? The tax paying citizen or the private subcontracted tool who's writing productive people tickets purely for the profit of the City government. What purpose does the fee or fine serve? Nobody goes downtown anymore minus the drug addicts and bums.

What's Really Going On?

As near as I can tell the only thing this guy is guilty of is "contempt of meter maid" give me a break they are known to be so mean as to ticket there own mothers and children! Any that I have encountered have a distinctly irritating and confrontational demeanor, uuggghh. So, lets say I go to the post office thinking I'll be longer than I am, lots of time left on the meter, is the person taking my space guilty of using up the remaining time "plug". I personally plan on filling the meter to the max each and every time I use a space with a meter. OMG, Good Grief Eugene P.D. :(, Shame on you. BEN BOND, I WOULD BE PROUD TO KNOW YOU!
